Minnesota Reacts to New Navigable Waters Protection Rule

Minnesota Farm Bureau Federation President Kevin Paap commented Thursday on the new Navigable Waters Protection Rule developed by the U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers.

"Minnesota Farm Bureau appreciates the...repealing and replacing [of] the 2015 Waters of the U.S. (WOTUS) rule with a new Clean Water rule," said Paap. "Over the past five years, Farm Bureau members have strongly advocated for clear rules that clarify the federal-state partnership established in the Clean Water Act."

"Minnesota farmers and ranchers value clean water and clear rules. The new Clean Water Rule provides much needed regulatory clarity and certainty to make confident decisions regarding water management on our farms by clearly knowing if it is regulated by Federal rules or regulated by state rules. Minnesota Farm Bureau appreciates the leadership from members of the Minnesota Congressional delegation and the Administration in finding needed clarity for farmers and ranchers," he added.

In addition, Bill Gordon, soy grower from Worthington, Minn., and American Soybean Association president, also commented.

"We are pleased that this rule replaces the 2015 rule, which was cumbersome and confusing, and that new regulation will better provide certainty and clear direction for our farmers," said Gordon. "We have long rallied for a replacement rule that protects our waterways while still offering a workable solution for farmers and that does not impose undue burden on agriculture."

The rule also lists which waters are not subject to federal control, like ponds created from rainfall, farm and roadside ditches and farm and stock watering ponds.

The rule should go into effect in March.
