The Land Stewardship Project (LSP) and Food & Water Watch have filed a lawsuit against the Minnesota Pollution Control Agency (MPCA) over its decision not to require an Environmental Impact Statement (EIS) for Riverview LLP’s proposed West River Dairy expansion near Morris, Minnesota. The groups argue that regulators failed to adequately evaluate the project's potential environmental and community impacts before approval.
If completed, the expansion would house 18,855 dairy cows, making it the largest dairy operation in Minnesota. Opponents estimate the facility would generate more than 200 million gallons of manure annually and significantly increase greenhouse gas emissions.
The lawsuit seeks judicial review of the MPCA's decision, claiming the agency did not fully consider possible effects on climate, water quality, and nearby communities. Food & Water Watch and FarmSTAND are representing the Land Stewardship Project in the legal challenge.
Environmental groups have raised concerns about the project's proximity to the impaired Pomme de Terre River and a nearby creek. They also argue that manure management practices could increase the risk of nitrate contamination in groundwater and drinking water supplies.
FarmSTAND and Food & Water Watch maintain that a more comprehensive environmental review is necessary before the project moves forward. The organizations contend that large-scale dairy operations can have significant impacts on natural resources, rural communities, and local economies.
Riverview currently operates 16 large dairy facilities in Minnesota and manages more than 135,000 cows statewide. The company has also proposed additional large-scale dairy projects in North Dakota and South Dakota, attracting continued attention from environmental advocates and community organizations.
